Vietnam’s legislation on import quota system of recyclable materials

Vietnam will implement a quota system for the import of recycled materials. The maximum amount of imported recycled materials is 80%, and the remaining 20% must come from China. The policy is expected to be implemented on January 1, 2025.

The quota implementation standard is calculated based on the design capacity of the facility, that is, 80% of the design capacity of raw materials can be imported, and the other 20% must be domestic raw materials.

This policy only allows the import of recycled raw materials for production, and shall not import raw materials for secondary processing or resale. Imported waste paper is only allowed to be used for the production of paper products and commodities, but commercial pulp is excluded from this policy. Waste plastics are only allowed to be imported by operators of commercial recycling bead production facilities before December 31, 2024.

Enterprises importing recycled raw materials need to pay Vietnamese Dong deposit from credit institutions in Vietnam to pay any potential costs involved in returning or destroying materials that are not allowed to be imported.

If the deposit is not enough to cover the cost of returning or destroying illegal materials, the importer must supplement the additional cost.

The decree also stipulates that the storage place of imported recycled materials and the inspection time of materials approved by the Customs Department must be reported to the Vietnamese customs authorities for further inspection by customs officials.

If the materials to be inspected are consistent with the export country, supplier, name, type, technical characteristics and origin of the inspected materials, or certified by the evaluation agency, the importer may apply for exemption from inspection.

The recycled materials imported for five consecutive times comply with Vietnam’s environmental technical regulations, and the Ministry of finance can issue an inspection exemption certificate. Vietnam has not disclosed when these measures will be implemented.

In November 2020, Vietnam passed the environmental protection law, and the above new rules are part of the law.
