While formulating and implementing the positive list of EIA examination and approval, the Ministry of ecology and environment also formulated the positive list of implementation supervision and law enforcement to play an incentive oriented role.
In this list, the Ministry of ecological environment said it would exempt some enterprises from on-site law enforcement inspection. For the enterprises closely related to the production of epidemic prevention and control materials and the guarantee of people’s livelihood, with small pollution emissions and strong ability to absorb employment, involving management norms in major projects and key areas, and with high environmental performance level, no on-site law enforcement inspection shall be conducted.
At the same time, we will promote off-site supervision. Make full use of remote sensing, UAV patrol, online monitoring, video monitoring, energy monitoring, big data analysis and other scientific and technological means to carry out off-site inspection, and timely remind the resumption of normal operation of pollution control facilities.
The Ministry of ecological environment pointed out that when implementing the positive list of supervision and law enforcement, it will implement “double random and one open” supervision. We will standardize the exercise of the discretionary power of administrative punishment, strictly enforce the law in accordance with the statutory authority and procedures, and prudently take measures to seal up, detain, restrict production and stop production. For those who are directly affected by epidemic prevention and control, and whose environmental violations are minor and corrected in time without causing environmental harm, they may not be punished, and urge the rectification as soon as possible. If the rectification fails to be completed on time due to the direct impact of epidemic prevention and control, the rectification period may be extended as appropriate.
